Classification of cookies

Types of cookies based on the entity that manages them

Types of cookies based on their purpose

There are many purposes for using cookies. Depending on the purpose for which the data collected through cookies is processed, some of the main types are as follows:

a) Technical cookies: These allow users to browse a website, platform, or application and use the different options or services available, including those used by the website owner to manage and operate the site, enable its functions and services, such as controlling traffic and data communication, identifying the session, accessing restricted areas, remembering items in a shopping cart, completing an order process, managing payments, preventing fraud related to service security, submitting registration or participation forms for an event, counting visits for software license billing purposes, using security elements during browsing, storing content for video or audio streaming, enabling dynamic content (e.g., loading animations), or sharing content on social networks.

Also included in this category, due to their technical nature, are those cookies that allow the most efficient management of advertising spaces that the website owner may have included as part of the design or layout of the website, application, or platform, based on criteria such as the edited content, without collecting user information for other purposes, such as customizing advertising or other content.

Technical cookies are exempt from the obligations established in Article 22.2 of the Spanish Law on Information Society Services (LSSI) when they are used to provide the service requested by the user. However, if these cookies are also used for non-exempt purposes (e.g., behavioral advertising), they will be subject to such obligations.

b) Preference or customization cookies: These allow information to be remembered so that the user can access the service with certain characteristics that may differentiate their experience from that of other users, such as language, the number of results to display when performing a search, the appearance or content of the service depending on the type of browser used, or the region from which the user accesses the service. If it is the user themselves who chooses these features, these cookies are exempt from the requirements of Article 22.2 of the LSSI, as they are considered a service expressly requested by the user, provided that they are used exclusively for that purpose.

c) Analysis or measurement cookies: These enable the monitoring and analysis of user behavior on websites to which they are linked, including quantifying the impact of advertisements. The information collected through these cookies is used to measure website, application, or platform activity in order to make improvements based on the analysis of usage data.

Regarding the processing of data collected through analysis cookies, the Article 29 Working Party (now EDPB) stated that, although informed consent is required for their use, they are unlikely to pose a risk to user privacy as long as they are first-party cookies, process aggregated data for strictly statistical purposes, provide information on their use, and offer the user the option to refuse them.

d) Behavioral advertising cookies: These store information on user behavior obtained through continuous observation of browsing habits, enabling the creation of a specific profile to display advertising based on that profile. These types are indicative and the most common; website owners and third parties may adapt classifications to their specific purposes, provided transparency with users is maintained.

Types of cookies based on duration

a) Session cookies: These are designed to collect and store data while the user accesses a website. They disappear when the session ends.

b) Persistent cookies: These store data on the user’s device and can be accessed and processed for a period defined by the cookie controller, which can range from a few minutes to several years.
